Step 1: Report & On-site Crackdown

The crackdown starts from tips, platform data, or on-site inspections. Delivery platform account information becomes key evidence. Running away at this point worsens the situation.

Step 2: Immigration Office Questioning (Within 72 Hours)

Immigration authorities conduct questioning within 72 hours of arrest. You have the right to request an interpreter. Your statement affects all subsequent procedures. Hire a lawyer at this stage first.

Step 3: Stay Restriction or Detention

Am I deported the same day I am caught?
No. You are not deported immediately. The legal process must be followed: questioning → stay restriction or detention → prosecutor's decision → deportation order. The entire process usually takes 2-3 months. Including the appeal period (5 days), it takes at least a few weeks. Hiring a lawyer during the process can change the outcome.
How long after deportation can I return to Korea?
The re-entry ban after deportation is usually 5-10 years. If the illegal employment period was long or it is a repeat offence, it can be 10 years. If it is a first offence and you were cooperative, it may be reduced to 5 years. During the re-entry ban period, entry for tourism is also not possible. You can apply to the Ministry of Justice to lift the ban, but approval is rare. Applying through a lawyer is more effective.
What happens if I run away or hide?
Running away makes the situation worse. Illegal stay time accumulates and punishment is aggravated. The immigration office tracks through platform data, bank accounts, and phone location.
